Commercial Terms & Conditions of Engagement

By clicking "I agree to the terms & conditions" signing an agreement, or paying an invoice issued by Recording Studio Designs (trading as Wildback Partnership), you agree to be bound by the terms outlined below.

1. Acoustic & Soundproofing Design Services

1.1 Digital Deliverables & Calculations

  • All acoustic designs, calculation sheets, room treatment specifications, and tailored PDF reports are bespoke professional services.
  • Email and Video Consultation is charged at our hourly rate.
  • No Refunds: Full payment confirms your order. Once payment is received, work commences immediately, and no full or partial refunds will be issued.
  • Customer Specifications: The client is solely responsible for providing exact site dimensions, boundary details, and structural information. Any calculation errors, recalculations, or design alterations resulting from inaccurate client data will be charged at our standard hourly rates.

1.2 Impact Assessments & Statutory Approvals

  • All soundproofing designs must be validated by an independent, certified noise impact assessment company. An external environmental noise survey must be commissioned to establish ambient baseline levels.
  • If the client fails or declines to commission an independent noise impact assessment, the client assumes full legal and structural responsibility for soundproofing performance.
  • Most local planning authorities require an independent noise impact report to validate soundproofing plans prior to granting planning consent. Once planning approval is granted, further testing post-build is generally not mandated by local councils.
  • The independent noise impact company will guarantee the sound proofing design provided by Recording Studio Designs.

1.3 Dimensional Tolerances & Performance

  • Acoustic design documents specify strict room dimension tolerances. It is the client’s responsibility to ensure that the site construction strictly adheres to these dimensional constraints.
  • Site measurements must be verified prior to starting construction. If existing conditions prevent compliance with internal tolerances, recalculations will be required and billed to the client at our standard hourly rate.
  • Recording Studio Designs accepts no liability for acoustic shortfalls if the finished space deviates from the supplied acoustic specifications. Remedial work in such instances is performed entirely at the client’s expense.

3. Detailed Package Clauses

3.1 Option 1: Turnkey Packages

  • Recording Studio Designs manages end-to-end delivery, acoustic construction, and installation.
  • Payments: 50% deposit confirms the booking and schedule; 45% due on the first day on-site; 5% due within 7 days of project sign-off.
  • All milestone payments are strictly non-refundable once paid.

3.2 Option 2: Client Acts as Contractor (Recording Studio Designs as Labourer)

  • Risk Allocation: The client trades operational risk for reduced project costs by eliminating contractor markups on materials. Recording Studio Designs acts solely as a specialist labour provider.
  • Schedules: Works typically operate on an alternating cycle of one week on, one week off, unless agreed otherwise in writing.
  • Material Fluctuations: Recording Studio Designs provides itemised material procurement lists. Material costs fluctuate; clients are urged to buy all materials immediately upon receipt of the schedule. Additional materials or labor extensions resulting from site delays will be invoiced to the client as incurred.
  • Performance Guarantee: Recording Studio Designs warrants acoustic performance and soundproofing criteria only to the extent of our own installed scope, excluding unknown structural building defects. Please see the independent noise impact assessment 1.2 above.

3.3 Option 3: Client is the Contractor (Skilled Labour Supply Only)

  • Role Clarification: The client manages all aspects of the site, safety, subcontractors, and logistics. Recording Studio Designs provides skilled acoustic labour and technical direction only.
  • Supervision Disclaimer: Because client-sourced workers and external trades work alongside or outside of our direct presence, Recording Studio Designs assumes no liability for acoustic deficiencies, installation defects, or material failures arising during unmonitored periods or due to changes made after design submission.
  • Statutory Roles & Principal Architect: Recording Studio Designs does not act as the Principal Designer or Principal Architect under UK Building Regulations / CDM Regulations for domestic or commercial builds. The client must formally assume these roles and associated liabilities.
  • Tools and Equipment:
    • Recording Studio Designs brings professional equipment to site. If client-appointed workers use our tools, or if our tools remain on-site overnight, the client accepts financial liability for any damage, loss, or theft.
    • The client must maintain adequate site insurance covering our tools at full replacement value. An inventory of equipment will be submitted upon mobilisation.

4. Hourly Rates, Scope Changes & Payment Default

  • Any amendments to construction drawings, acoustic specifications, or material lists requested after issuance will be billed at our current hourly professional rate.
  • Invoices must be cleared before the release of subsequent project stages or site arrivals.
  • Late payments pause site works immediately; mobilisation fees and rescheduling delays resulting from paused sites are the responsibility of the client.
